Who we are

EarnKind is the trading name used by Liam Cain for a UK website design and management service. Liam Cain, trading as EarnKind, is the data controller.

What information we use

Depending on how you interact with EarnKind, we may use:

• business contact details such as name, role, business email address and business phone number;
• information you send us in enquiries, approvals, service requests and correspondence;
• customer billing, invoicing and payment-status information;
• public information about a business and its representatives, including information from business websites, public social profiles, directories, review platforms and Companies House;
• technical information needed to operate and secure our website and services, such as basic server/security logs; and
• records of marketing preferences, objections and suppression.

We do not deliberately collect sensitive personal information for prospecting.

Where information comes from

We receive information directly from people who contact or become customers of EarnKind. For business prospecting we may also obtain limited business-contact information from public sources, including the business’s own website and public social profiles, business directories, Companies House and review/listing services.

Why we use information and our lawful bases

1. To respond to enquiries and discuss services — legitimate interests and, where relevant, steps requested before entering a contract.
2. To assess whether a business may be a relevant EarnKind prospect and conduct carefully targeted B2B marketing — legitimate interests. Our interest is growing EarnKind through proportionate, relevant business-to-business outreach. We restrict this activity, use public/business-context information, check suppression, and do not automate sending purely because a prospect receives a score.
3. To provide, manage and support customer services — performance of a contract and legitimate interests in operating the service effectively.
4. To invoice, reconcile payments and keep financial records — performance of a contract and legal obligations.
5. To protect our systems, prevent misuse and maintain records of decisions, objections and disputes — legitimate interests and, where applicable, legal obligations.

Direct marketing

Our default unsolicited email prospecting pool is verified corporate subscribers such as active UK limited companies and LLPs. We do not treat sole traders or ambiguous subscriber types as corporate by assumption.

Marketing messages identify EarnKind and provide a straightforward way to object or opt out. If you object to direct marketing, we will stop using your personal information for that purpose. We may keep the minimum information needed on a suppression record so that we do not contact you again accidentally.

If we obtained your personal information from a public or third-party source rather than directly from you, we will provide or make available this privacy information within the period required by data-protection law.

Who we share information with

We use service providers needed to run EarnKind. Depending on the service in use, these may include:

• Google Workspace for business email, documents and operational records;
• GitHub for private source-code and delivery records;
• Cloudflare for website hosting, delivery and security; and
• a payment provider such as Stripe if and when payment processing is activated.

We only share information where needed for the relevant service, administration, legal requirement or protection of our rights. We do not sell personal information.

International processing

Some service providers may process information outside the UK. Where this occurs, we rely on the provider’s applicable UK data-transfer safeguards and contractual arrangements. We review this when selecting or materially changing providers.

How long we keep information

We keep information only for as long as reasonably necessary for the purpose for which it was collected, including legal, accounting and compliance needs. Our working retention rules are:

• rejected/uncontacted prospect personal contact data — normally deleted within 90 days once no longer needed for qualification, unless required for suppression or compliance evidence;
• enquiries and contacted prospects — normally up to 24 months after the last meaningful interaction, unless a longer period is needed for an objection, dispute or legal reason;
• customer contract, service, invoice and payment records — normally up to 6 years after the relevant relationship or accounting period where needed for legal/accounting purposes;
• security/technical logs controlled by us — kept for a short operational period, generally no longer than 90 days unless an incident requires longer retention; and
• suppression records — the minimum identifier is retained for as long as reasonably necessary to honour the objection.

Automated decision-making

EarnKind may use automation to help prioritise or score business prospects. We do not use that scoring to make decisions that produce legal or similarly significant effects on individuals, and a score does not itself authorise contact.

Your rights

Depending on the circumstances, you may have rights to ask us for access to your personal information, correction, deletion, restriction, portability, or to object to processing. You have an absolute right to object to the use of your personal information for direct marketing.

Complaints

Cookies and similar technologies

EarnKind’s current preference is to keep its website simple and avoid non-essential tracking. If we introduce non-essential cookies, analytics, advertising pixels or similar storage/access technologies, we will update this notice and implement the required information and consent controls before using them.

Changes to this notice

We may update this notice as EarnKind’s services or suppliers change. The current version will be published on earnkind.co.uk with its effective date.
